Court Rejects Nyako’s Latest Motion

Former Adamawa State governor, Admiral Murtala Nyako’s motion seeking an injunction into restraining the trio of police, the Department of State Services (DSS) and the Economic and Financial Crimes Commission (EFCC) from arresting him has been rejected by the court.

The ex governor’s lawyer, O.E. Ogungbeje moved the motion for the injunction and asked the court to hold back the Inspector General of Police, DSS and EFCC from arresting him (Nyako) depending on the determination of an origination motion he filed for the enforcement of his fundamental rights.

Justice Ahmed Mohammed rejected the ex-governor’s motion on the ground of lack of sufficient reason for the court to restrain the security agencies, listed as respondents in the suit marked: FHC/ABJ/CS/474/2015.

“Having read through the supporting affidavit, particularly paragraphs 5 to 19 which contain facts relating to this case, this court is unable to accede to the request for order of interim injunction sought,” the judge said.

He also ordered Nyako to warn the respondents about any further application for injunction filed against them.

Governor Nyako has been wanted by Nigeria’s top security agencies over an alleged mismanagement of government funds meant for the Adamawa people.
